What does this information notice cover?

This information notice is provided pursuant to Article 13 of Regulation (EU) 2016/679 ("GDPR") and applies to personal data collected by Albergo San Felice S.r.l., with registered office in Capri (NA), Via Li Campi, No. 13 - in its capacity as data controller (hereinafter, "Albergo Sanfelice", the "Controller", "we" or "our", as the case may be) - through the video surveillance system at the Albergo San Felice premises.

What categories of personal data do we collect?

Through the video surveillance system at the Albergo San Felice premises, images relating to your person may be acquired and recorded. Providing your personal data is mandatory whenever you access a monitored area.

How do we collect your personal data?

Images are directly captured through the cameras that make up the video surveillance system, and the presence of these cameras is indicated by a specific sign near the monitored area. We do not use any form of solely automated decision-making in relation to the processing of your personal data.

For what purposes and on what legal basis do we process your personal data?

Your personal data will be processed for the following purposes:

(1) to protect personnel, property, and company assets;

(2) to prevent, investigate, and prosecute criminal offenses and disciplinary violations;

(3) to ascertain, exercise, or defend a legal right in judicial or administrative proceedings or in arbitration or conciliation procedures..

The processing of data for the above purposes does not require your consent as it is necessary for the pursuit of our legitimate interests related to the same purposes, pursuant to Article 6(1)(f) of the GDPR.

How do we store your personal data?

We adopt security measures to protect your personal data from the risks of destruction, loss, or alteration (whether accidental or unlawful) as well as from unauthorized communication or access to the data.

How long do we retain your personal data?

The images will, in principle, be stored for a period not exceeding 24 hours from their recording, unless there are specific reasons for further retention due to holidays, office closures, or if required by law enforcement or judicial authorities. Further retention may also be necessary to ascertain, exercise, or defend a right.

Who will have access to your personal data?

Your personal data may be made accessible, communicated to, or disclosed to the following parties, who will act as authorized persons, data controllers, or independent controllers:

(1) our employees or collaborators of any kind;

(2) service providers and consultants, such as security service providers, IT service providers, lawyers, private investigators;

(3) authorities or public bodies, if and to the extent required or imposed by law.

Please note that if some of the above-mentioned entities are located outside the European Economic Area (EEA), we will transfer your personal data, in the absence of adequacy decisions and without applying any of the derogations under Article 49 of the GDPR, based on standard contractual clauses under Article 46(2)(c) and (d) of the GDPR.
